1. By reference (a) you stated that you are "gay". The Show Cause Authority reviewed your
case and determined that there is sufficient evidence of record to require you to show cause
for retention in the Naval Service.
2. As such, administrative action to require you to show cause for retention has been initiated
in accordance with references (b) and (c) based upon your statement that you are "gay" which is
defined as homosexual conduct under reference (b) and which creates a rebutable presumption that
you engage in, attempt to engage in, have a propensity to engage in, or intend to engage in homosexual
acts.
3. Commandant, Naval District Washington has been requested to convene a Board of Inquiry to require
you to show cause for retention in the Naval Service. The Board will consider your case even if you
decide not to appear before it. Your rights before the Board of Inquiry and the procedures for such
Boards are set forth in references (b) and (c).
4. The characterization of service that may be recommended in your case is Honorable or General
(under honorable conditions).
5. You may exercise or waive the following rights (see reference (c), enclosure (8) for a full list
of your rights):
a. You may rebut the presumption by presenting evidence demonstrating that you do not engage in,
attempt to engage in, have a propensity to engage in, or intend to engage in homosexual acts.
b. You may offer to submit, any time before the Board adjourns for closed deliberations, any
relevant or material matter that you deem pertinent.
c. You may tender a resignation request for an Honorable or a General (under Honorable conditions)
discharge in lieu of separation processing. Reference (d) contains the format for a resignation request.
d. You may confer with appointed military counsel, or civilian counsel at no expense to to the
government.
e. Upon your written request, you will be provided copies of the papers forwarded to the Secretary
of the Navy to support a recommendation for separation.
f. This letter and related administrative separation documentation may become part of your official
record if separation is approved. You have the right to submit a statement concerning the filing of
adverse material into your record per reference (e).
6. Please return enclosure (1) within 10 days of receipt of this letter. If you intend to tender your
resignation, return enclosure (1) with your request. Failure to exercise your rights or respond within
the specified time will constitute a waiver of your rights.
